2. Purpose

These general terms and conditions of sale govern the contractual relations between Hôtel La Particulière and any person making a reservation for hotel rooms and additional services offered by the Hotel to Customers on the Site, by telephone, by email,
by post, on site, through our reservation service or through an online travel agency.
The Customer declares that he is of legal age and has full legal capacity to enter into a commitment under these General Terms and Conditions.
Any reservation requires consultation and complete and unreserved acceptance of these General Terms and Conditions.

3. Rates

The hotel offers a single rate, refundable up to 72 hours before arrival. After this period, the first night will be charged at 100 %. 
Payment of the full reservation amount is required to confirm any reservation. 
In case of refusal by the bank card center, or in case of invalid card, the Hotel reserves the right to cancel the reservation without notice.
Prices may vary depending on time and day of booking.
The prices indicated are indicated in Euros and displayed including VAT. They take into account VAT at the rate applicable on the day of booking; any change in the rate applicable to VAT will be automatically reflected in the rates indicated on the billing date. The same will apply to any modification or introduction of new taxes imposed by the competent authorities. Tourist tax, government or local taxes may be requested in addition and will be payable directly on site to the Hotel unless otherwise specified at the time of booking.
The prices mentioned on the Site are subject to change at any time by the Hotel without prior information or notice. Only the price indicated in the booking confirmation by the Hotel is contractual.
The holder of the credit card used for the reservation must be the same as the person staying at the establishment.

4. Booking and cancellation conditions

Free cancellation
You can cancel your reservation free of charge up to 72 hours before your arrival date.
Late cancellation
If cancelled less than 72 hours before arrival, the first night will be charged at 100 %.
Any reservation only becomes final after receipt of written confirmation from our reservations department.
The Customer is reminded that, in accordance with article L. 221-28 paragraph 12 of the Consumer Code, he does not have a right of withdrawal.
In case of no-show, the Hotel will charge 100% of the total amount of the first night and the room will be made available again.

5. Displacement

In the event of unavailability of the establishment, in the event of force majeure, technical problem in the Hotel or for any other reason, the latter reserves the right to accommodate the Clients in whole or in part in a Hotel of an equivalent category for services of the same nature.
The Hotel cannot be held liable for payment of any additional compensation.

6. Force majeure

Neither party shall be liable to the other party for failure to perform its obligations resulting from a force majeure event. It is expressly agreed that force majeure suspends the performance of the parties' reciprocal obligations and that each party shall bear the cost of all costs incurred by it resulting from the force majeure event.
Cases usually recognized by the case law of the Court of Cassation are considered to be cases of force majeure, and in particular, a pandemic (excluding Covid 19), a terrorist attack, the destruction of the Hotel, a cut in the Hotel's electricity, water or heating supply, or a staff strike.

7. Payment terms

Payment of the entire reservation will be required to confirm the reservation. Accepted payment methods include credit cards, bank transfers and cash. 
Checks are not accepted.

8. Check-in and Check-out

Check-in : From 3:00 p.m.
Check-out : Until 12:00.
Additional charges may apply for late check-out, subject to availability.
Reception opening hours: 24/7
Rooms may be checked prior to check out. In the event of damage, penalties to be paid in cash to cover cleaning, replacement and/or repair costs may be charged to the Customer upon check out.

9. Hotel Liability

The rules relating to the theft of objects in hotels are set out in Articles 1952 to 1954 of the Civil Code. As a conventional limitation, in the event of theft of objects in the room or within the Hotel premises, the damages owed to the traveler are limited to the equivalent of one (1) time the rental price of the room per day.
The hotel cannot be held responsible for damage caused by events beyond its control (force majeure, strike, etc.). The hotel's liability is limited to the value of the booked stay only.

10. Customer Liability

The Customer is required to behave in a manner that respects good morals and public order during their stay at the Hotel, as well as to comply with the Internal Regulations. In the event of non-compliance with these rules, the Customer may be asked to leave the establishment without the right to compensation and/or reimbursement, even if a payment has already been made. If no payment has been made, the Customer must pay the amount of the reservation before leaving.
The Client is not authorized to bring in drinks or food from outside, unless the Hotel has expressly authorized it in advance.
The Client is responsible for any damage caused by himself or his guests in the Hotel and will have to bear all costs related to such damage, as well as to non-compliance with the mentioned rules (for example, the costs of intervention of the fire safety services).

11. Tobacco

Smoking and vaping are strictly prohibited in all common and private areas of the Hotel, outside of the areas specifically provided for this purpose.
A room cleaning fee of two hundred euros (€200) may be charged by the Hotel to the Client in the event of non-compliance with this instruction.

12. Personal data

The information collected during the booking process is necessary to manage your stay. In accordance with the General Data Protection Regulation (GDPR), you have the right to access, rectify and oppose your personal data. For more information, please consult our privacy policy.

13. Applicable law and disputes

These General Terms and Conditions are governed by French law. In the event of a dispute, the parties undertake to seek an amicable solution before taking legal action. Failing this, the dispute will be brought before the competent courts of common law. 
After contacting the Hotel's customer service to try to resolve the dispute amicably and, in the event of a negative response or no response within 60 days of the referral, the Customer may contact, in accordance with the provisions of Article L. 612-1 of the Consumer Code, the Tourism and Travel Mediator - BP 80303 - 75823 Paris cedex 17 - Email: info@mtv.travel

14. Acceptance of the conditions

Any reservation implies unreserved acceptance of these general conditions of sale.
